2/7/2007

A Settlement Conference has been scheduled on 2.08.07 at 10.30am before Judge Klein. It looks like the defendant may have agreed to plead guilty. At this hearing, a non-trial Judge will sit with the defendant and explain the case as it's charged. He will also go over the plea agreement and explain the possible sentence attached to it. If the defendant pleads guilty, Audrey's father will have the opportunity to address the court. He will also have an opportunity to address the court at the time of sentencing.

Audrey had another doctor's appointment on Friday 12/22/2006. It appears that she is healing very well considering the extent of her injuries. The doctor has given her the ok to stand up more often and to begin the process of learning how to walk again with her reconstructed legs. Since then, she has been able to get up and walk across the room without assistance.

Audrey had her first doctor's appointment since being released from the hospital on Monday 12/18/2006. Today she was able to stand up for the first time with a little assistance and painful legs since the hit-and-run.

Jose Angel Montes-Chavez is set t for arraignment  on Friday December 15, 2006. The arraignment  will be held at 8:30am at the Glendale Justice Court Facility:

Glendale, AZ 85301.

Audrey’s father spoke at the Avondale City Council meeting tonight to propose the construction of a traffic light at the intersection where his daughter was tragically struck by a hit-and-run driver on November 30th, 2006.  The city of Avondale has "pre-ordered" a traffic light since the accident but it is not scheduled for installation until summer 2007.  Mark proposed that the city should have some sort of safety precautions in place until the traffic light can be installed. He has also asked the Avondale City Council if they can move the installation date up. There will be an article in The Arizona Republic on Saturday December 16, 2006 about the Avondale City Council meeting.

PLEASE ATTEND THE AVONDALE CITY COUNCIL MEETING THIS MONDAY

On Monday, December 11th, Audrey’s father, Mark Marquez is speaking at the Avondale City Council meeting, which begins at 6:00 pm. One of the topics on the agenda for the night is updating and amending chapter 23 of the city code relating to speed limits, truck routes and school zones. We absolutely NEED a traffic light at the corner of Avondale Blvd and Whyman, where Audrey’s hit and run took place last week. Mark wants to get at least 500 people to arrive at 5:45 pm. PLEASE join him in getting the city to promptly put in a traffic light at the high school crosswalk so no more of our children are injured or possibly killed.

At 5 pm today, Audrey went home!!! She is doing a lot better and her family couldn’t be happier with her progress. Audrey is focused on her physical therapy and doing whatever it takes to have a quick and healthy recovery.

Avondale will be having a City Council meeting where one of the issues being discussed is the crosswalk at the high school. Audrey’s dad plans on attending and speaking. PLEASE join him in support of Audrey to get a light installed at the school intersection. Mark will have the date of the meeting posted here by Saturday morning. Check back, or inquire with the city of Avondale so you can attend in support of Audrey and her family.

Today Audrey had an ultrasound due to pain in her right leg. The results were negative, and doctors reported that her leg is in the same condition that it was following her operation. Unfortunately, her red blood cell count is down to an 8, and until she brings that up to a 12, she must remain in the hospital. Audrey ate more today, and is expected to reach a 9 – 9.5 blood count by tomorrow morning. If she continues to increase her amount of food intake and raise her count to a 12, her family looks forward to being able to take her home Friday afternoon.

Audrey has decided not to take any pain medication – she says, “she just wants to fight through it.” When asked, she said her level of pain is currently at 5 on a scale of 1 to 10. Such a strong girl. The fact that she isn’t masking her discomfort has inadvertently given doctors an advantage in determining Audrey’s healing progress. She is able to let them know exactly what’s happening with her body and if anything needs attention.

Audrey's red blood cell count is still very low, so they may have to operate on her spleen. Tomorrow they will give her a second blood transfusion and hopefully she can go home on Thursday.  Check back tomorrow night for another update.
